Privacy Policy

This policy explains what personal information we collect through part9loans.com.au, why we collect it, who we give it to, and what you can do about it. It is written to meet our obligations under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and under Part IIIA of that Act, which governs credit reporting.

What we collect

If you complete the enquiry form we collect the answers you give us, which include your name, mobile number, email address and postcode, along with information about your financial situation.

Some of that information is sensitive. In particular, telling us where you are up to with a Part IX debt agreement, whether your payments are up to date and whether you have had defaults is information about your credit history and personal insolvency. We ask for it because a broker cannot tell you anything useful without it, and we treat it accordingly.

We also automatically collect technical information: your IP address, browser and device type, the page you arrived from, and any campaign parameters in the link you followed.

Why we collect it

To pass your enquiry to Simple Loans Pty Ltd so they can assess whether they are able to help you with a vehicle or asset loan, and to contact you about that enquiry. This website does not assess applications and does not submit them to lenders.

We also use aggregated, de-identified information to understand how people use the site and where the form is confusing. Names, email addresses, phone numbers and postcodes are stripped before anything is sent to our analytics tools, and income is recorded as a range rather than a figure.

Who we disclose it to

We disclose your enquiry to Simple Loans Pty Ltd, an Authorised Credit Representative, so that they can contact you and assess whether they can assist you. Simple Loans may then disclose your information to credit providers on their panel for the purpose of assessing a loan. We only do this after you have given consent at the point of enquiry.

We also use service providers who host our systems, send email and provide analytics. They are bound to use the information only to provide those services to us.

We do not sell your information, and we do not supply it to lead brokers or aggregators. Your enquiry goes to Simple Loans and nowhere else. If you completed the form and were told you are not eligible because you are under 18 or not an Australian resident, your details are not forwarded at all.

Some of our service providers store data on servers located outside Australia, including in the United States. Where that happens we take reasonable steps to ensure the recipient handles your information consistently with the Australian Privacy Principles.

Consent, and how to withdraw it

The consent you give on the enquiry form covers having your details passed to Simple Loans Pty Ltd, and being contacted by them by phone, SMS and email about vehicle finance. It is a separate, unticked checkbox rather than something bundled into accepting these terms.

You can withdraw that consent at any time by telling the person who calls you, replying STOP to an SMS, using the unsubscribe link in an email, or emailing us at the address below. Withdrawing consent does not affect anything already done, but it stops anything further.

How long we keep it

We keep enquiry records for seven years, which reflects the record-keeping obligations that apply to credit assistance. After that they are deleted or de-identified.

If you ask us to delete your information sooner and there is no legal obligation requiring us to keep it, we will.

Security

Information you submit is transmitted over an encrypted connection and stored in access-controlled systems. Access is limited to people who need it to do their job.

No system is perfectly secure. If a data breach occurs that is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.

Accessing and correcting your information

You can ask for a copy of the personal information we hold about you, and ask us to correct anything that is wrong. Email privacy@simpleloans.au and we will respond within 30 days. There is no charge for making a request.

We may need to verify your identity before releasing information, which is a protection for you rather than an obstacle.

Complaints

If you think we have mishandled your information, tell us first, email privacy@simpleloans.au and we will investigate and respond within 30 days.

If you are not satisfied with our response, you can complain to the Australian Financial Complaints Authority, which provides free and independent dispute resolution, or to the Office of the Australian Information Commissioner at oaic.gov.au.
